This crime can be translated as “Quasi Like-Rape.”

“Quasi” means the victim was (already) incapacitated/asleep, and the perpetrator took advantage of that. “Like-Rape” refers to forcible oral/anal sex or other forcible touching of the genitals.

Recently here in Korea, a physician was found guilty of this crime and sentenced to 2 1/2 years in prison (no probation). The charge was that he had inserted his fingers inside the genitals of his female patients while they were unconscious (for colonoscopy).

This was an appellate court decision (by the Seoul High Court). The lower court had originally sentenced him to 3 1/2 years in prison, but the sentence was reduced to 2 1/2. The reasoning was that he had reached a monetary settlement with a victim + had given 30 mil won to charity + had pledged to donate his organs upon death, etc. (In Korea, sex-related crime offenders can no longer rely on a settlement to get them off the hook 100%.)
