4. 범죄사실 및 고소이유 (Statement of Facts and Reasons for Complaint)
피고소인은 0000년 0월 0일 ○○시 ○○구 ○○동 ○○번지 소재 피고소인의 집에서 전화로 고소인이 운영하는 ○○다방에 차를 주문한 후, 이를 배달하러 온 고소인을 발견하자 손으로 밀쳐 방바닥에 눕힌 다음 고소인의 하의와 속옷을 벗겼습니다. 이후 “말을 듣지 않으면 죽여버린다”고 협박하면서 옆에 있던 지팡이로 고소인의 머리를 때려 고소인의 반항을 억압한 후 강간하려 하였으나, 때마침 고소인을 찾으러 온 ○○다방 종업원 ○○○에게 발각되어 강간에는 이르지 못했습니다.
그러나 이 과정에서 고소인은 약 ○주간의 치료를 요하는 두피 좌상 등 상해를 입었습니다.
On ○○/○○/0000 at around ○○:○○, the accused ordered tea by phone from the ○○ Café operated by the complainant, requesting delivery to the accused’s residence located at ○○-○○, ○○-dong, ○○-gu, ○○ City. When the complainant arrived for the delivery, the accused pushed the complainant to the floor, removed the complainant’s pants and underwear, and threatened, “If you don’t listen, I will kill you.” The accused then struck the complainant on the head with a cane, suppressing resistance, and attempted to rape the complainant.
The attempt was interrupted when a café employee, ○○○, arrived searching for the complainant. Although rape did not occur, the complainant sustained injuries including a scalp contusion requiring approximately ○ weeks of treatment.
