3. 고소취지

  1. Purpose of Complaint

고소인은 피고소인을 상대로 아래와 같이 감금죄로 고소를 제기하오니 철저히 조사하여 법에 따라 엄벌에 처해주시기 바랍니다.

The Complainant hereby files this complaint against the Accused for the crime of unlawful confinement as stated below, and respectfully requests a thorough investigation and strict punishment in accordance with the law.

4. 범죄사실 및 고소이유

  1. Facts of the Crime and Reasons for Complaint

가.
고소인은 0000. 0. 0. “○○기업”이라는 사채업을 하는 피고소인으로부터 금 1,000만원을 월이식 ○푼으로 하여 차용한 사실이 있었는데, 고소인은 피고소인에게 금년 ○월까지는 이자를 지급하여 왔으나 사업부진으로 같은 해 ○월 이후부터는 이자를 지급하지 못하고 있었습니다.
그러자 피고소인이 0000. 0. 0. ○○:○○경 고소인을 찾아와 잠깐 이야기를 하자며 피고소인의 집으로 데려가 원금과 연체이자 합계 ○○만원을 모두 갚으라고 요구하였습니다.

On 0000. 0. 0., the Complainant borrowed KRW 10,000,000 from the Accused, who operates a private lending business under the name “○○ Enterprise,” at a monthly interest rate of ○%.
The Complainant paid interest to the Accused until ○ of this year; however, due to business difficulties, he failed to make interest payments from ○ of the same year onward.
Subsequently, on 0000. 0. 0., at around ○○:○○, the Accused visited the Complainant and, saying he wanted to talk briefly,
took him to the Accused’s residence and demanded repayment of the principal
and overdue interest totaling KRW ○○ million.

고소인은 현재 사업부진으로 부득이 차용한 돈을 변제하지 못하고 있는 사정을 이야기하면서 몇 개월만 기다려 달라고 부탁하였으나, 피고소인은 돈을 갚기 전에는 나갈 수 없다며 다음 날 ○○:○○까지 창문도 없는 자신의 집 창고에 감금하였습니다.
따라서 피고소인을 철저히 조사하시어 다시는 고소인과 같은 피해를 입지 않도록 엄벌에 처해 주시기 바랍니다.

The Complainant explained that due to current business difficulties, he was unable to repay the borrowed money and asked for a few more months.
However, the Accused stated that the Complainant could not leave without repayment and confined him in a windowless storage room inside the Accused’s home until ○○:○○ the following day.
Therefore, the Complainant requests a thorough investigation and strict punishment to prevent similar harm from occurring again.
