3. 고소취지 (Purpose of Complaint)

고소인은 피고소인을 협박죄로 고소하오니, 철저히 조사하여 법에 따라 엄벌에 처해 주시기 바랍니다.
The complainant hereby files this criminal complaint against the accused for the offense of Threats and respectfully requests a thorough investigation and punishment to the fullest extent of the law.

4. 범죄사실 및 고소이유 (Facts and Reasons for Complaint)

가. (A.)

고소인은 0000. 0. 0., 피고소인 소유의 점포를 임대보증금 3,000만원, 월임료 70만원, 임대기간을 0000. 0. 0.까지로 정하여 임차하여 현재까지 슈퍼를 운영하고 있습니다.

On 0. 0. 0000, the complainant leased from the accused a commercial unit with a deposit of 30 million KRW, monthly rent of 700,000 KRW, and a lease term ending on 0. 0. 0000, and has since been operating a convenience store (supermarket) at the premises.

그런데 피고소인은 최근 자신이 그 점포에서 슈퍼를 운영하겠다며, 임대차기간이 아직 만료되지 않았음에도 수차례에 걸쳐 고소인에게 점포를 비워달라고 요구하였습니다.
However, the accused recently stated an intention to operate the store personally and repeatedly demanded that the complainant vacate the premises even though the lease period had not yet expired.

그러다가 0000. 0. 0. 17:30경 고소인을 직접 찾아와
“20일 내로 점포를 비워주지 않으면 고소인 및 고소인의 가족을 죽여버리겠다”며 위협하였습니다.

Then, on 0. 0. 0000 at approximately 17:30, the accused visited the complainant and threatened: “If you do not vacate the store within 20 days, I will kill you and your family.”

나. (B.)

고소인은 이 협박 이후 피고소인이 자신 또는 가족에게 실제로 위해를 가할 수 있다는 극심한 두려움 속에 생활하고 있으며, 자녀가 학교나 외출을 할 때에도 직접 데려다줄 정도로 일상생활이 어려운 상태입니다.

Following the threat, the complainant has been living in constant fear that the accused may inflict physical harm on the complainant or the complainant’s family.
The complainant has become unable to maintain ordinary daily life, even escorting the children to school or outside out of fear.

또한 고소인은 극심한 정신적 고통을 겪고 있으며, 신경쇠약 증세까지 발생하여 치료를 받고 있습니다.

The complainant is suffering severe psychological distress, including symptoms of nervous breakdown, and is currently receiving medical treatment.

다. (C.)

따라서 고소인은 본인 및 가족의 안전을 위해 피고소인을 고소하는 바, 존경하는 검사님께서 철저히 조사하시어 피고소인이 다시는 약한 세입자를 괴롭히지 못하도록 엄벌에 처해주시기 바랍니다.

Therefore, for the safety of the complainant and the complainant’s family, this complaint is filed. The complainant respectfully requests that the prosecution thoroughly investigate the accused and impose strict punishment so that the accused can no longer intimidate or harm vulnerable tenants.
